As a landowner you will eventually have someone request an easement over your land. Often, this will be a power line company or an oil and gas pipeline company.

The company will give you an easement to review and sign when this happens.

In the easement it will mention where the power line or gas pipeline will be located and the width of the easement. Many times, the description is very broad and not clear.

Can we give you some very important advice?
Do not sign an easement unless it is crystal clear about the location and width of the easement.

We asked Casey Thompson, Of Counsel with our Firm to answer the question “What is an easement?”

PS. You can call a local surveyor and request him/her to prepare a survey showing the exact length, width, and location of the easement. Then, use the survey and description in the easement document.
