Its safest to let the other party know you are going to record the conversation and keep yourself out of trouble. “This call is being recorded for quality assurance purposes”.
However, Texas is called a “one-party consent” state for recording conversations – means you could record someone you are speaking with (you have consented); however, if that person is out of state different laws may apply.
There are some nuances related to people in public places who could expect to be overheard but, in any event, calls for purposes of committing a criminal act can NOT be recorded. No blackmail calls.
PS. Just let the other person know you are going to record the call – it may make the conversation calmer also!
