If you are doing construction or repair work on a person’s residence (called homestead), then you must have these in place to get your mechanic’s lien:

  • A disclosure statement must be provided to the owner before a contract is signed.
  • A written contract with the owner (and owner’s spouse- if married) before construction starts.
  • The contract must contain the terms of the agreement.
  • The contract must be filed in the real property records in the county where the home is located.

PS. Securing a mechanic’s lien can be very tricky and technical.  Call us sooner rather than later if you feel like receiving payment may be an issue.
